The Department of School Education Issues A Warning To Kashmirs Private Schools

Srinagar, December 23: The School Education Department of Kashmir issued a warning on Saturday, December 23, ahead of the admissions session, to accredited private schools not to perform child interviews or screening processes and not to charge a capitation fee.

Additionally, the department stated that the Kashmir division’s private accredited schools would no longer be able to charge an entrance fee or any other unannounced fees.

The Director of School Education Kashmir (DSEK) stated in a circular that some accredited private schools charge a capitation fee upon admission and require screening tests of both the student and their parent or guardian.

“No school or person shall, while admitting a child, collect any capitation fee and subject the child or his or her parents or guardian to any screening procedure,” according to Section 13 of the Right to Education Act of 2009.

According to the government, in addition, any school or individual that violates sub-section (1) of the Right to Education Act 2009 and “receives capitation fee, shall be punished with fine which may extend to ten times the capitation fee charged or if that school subjects a child to screening procedure, shall be punished with fine which may extend to twenty-five thousand rupees for the first contravention and fifty thousand rupees for each subsequent contravention” is subject to legal action under section 13 of the Act.

It is important to note that capitation fees are any donations, admission fees, contributions, or payments made in addition to the fees that the school notifies you of.

“Numerous grievances from civil society and parents are flooding in regarding the demand for an admission fee by private schools, which is completely illegal and a crime,” stated DSEK.

Additionally, it stated that many schools are deviating from the national academic calendar, which is in line with NEP-2020, and that the academic session in Jammu and Kashmir has changed to align with it. The admission period for schools is supposed to start in March.

Accordingly, it states, “Given the circumstances, it is impressed upon all the private recognised schools of Kashmir division to desist from collecting the capitation fee (admission fee) and other non-notified fees and to refrain from interviewing or screening children for admission.”

The directorate went on to state that any deviation from the rules in this regard by any school would result in action taking the form of the school’s registration being cancelled.

In order to guarantee that these circular instructions are followed in letter and spirit, DSEK designated all Chief Education Officers as nodal officers in their respective jurisdictions—(KNO)
